叫停针对涉罪人员近亲属的“连坐”，要求修改招工、招干中使用特定民族文字答卷者优先录用的规定……这些出现在全国人大常委会法工委2023年备案审查工作报告中的案例，不久前登上热搜，赢得众多网友的赞誉。这是2017年以来的第七份备案审查工作报告。
7年来，公民、组织提交备案审查建议接近两万件，存在强制亲子鉴定、人身损害赔偿城乡“同命不同价”、小区业主参选业委会成员必须按时缴物业费等问题的规范性文件被纠正。
如今，在我国建立运行40多年的备案审查制度有了里程碑事件，2023年12月29日，十四届全国人大常委会第七次会议通过了《全国人民代表大会常务委员会关于完善和加强备案审查制度的决定》(以下简称《决定》)。这是全国人大常委会首次对备案审查制度作出立法性规定，22条的《决定》被学界称为“小备案审查法”。
全国人大常委会法工委法规备案审查室主任严冬峰介绍，党的二十大报告提出，“加强宪法实施和监督，健全保证宪法全面实施的制度体系”，要求“完善和加强备案审查制度”。全国人大常委会2023年度工作要点和立法工作计划也对出台完善和加强备案审查制度的决定提出任务要求，明确2023年制定出台该决定。《决定》的出台，是完善备案审查制度建设的一项重要举措，将为今后开展备案审查提供法律依据和法治保障，更好地推动备案审查工作的进行。
备案审查“长了牙”，还要有“咬合力”
备案审查重点审查什么，用什么标准审查？严冬峰表示，《决定》将审查重点内容整合细化为6种情形：是否符合宪法规定、宪法原则和宪法精神；是否符合党中央的重大决策部署和国家重大改革方向；是否超越权限，减损公民、法人和其他组织权利或者增加其义务；是否违反上位法规定；是否违反法定程序；采取的措施与其目的是否符合比例原则。
“备案审查的比例原则，是《决定》的一项重点制度创新。”严冬峰举例说，几年前有的地方性法规规定停车要交费，不交停车费要罚款。罚款200元起，高的要罚500元、1000元。全国人大常委会法工委提出审查意见，认为很小的违法行为，处罚过重，用比例原则来讲，就是处罚不符合比例。“当时处理这个问题，发了问卷，到社区调研，还随机访问了很多人，就是要把这起案件做得更精准、更量化一些。”
“只要发现了问题，不会大事化小、小事化了，肯定要解决问题。”严冬峰说，备案审查“长了牙”，还要有“咬合力”，只要发现问题，后续工作一定要做到位，推动有效解决，真正发挥备案审查的作用。
“备案审查工作要通过沟通、提审查意见等柔性的纠错方式来推动问题解决，同时也需要刚性的纠错机制来推动解决问题，《决定》进一步发挥全国人大常委会的作用，增强纠错的刚性。”严冬峰表示，《决定》明确坚持有错必纠，增强备案审查制度刚性，在规定通过沟通、提出书面审查意见等“柔性”纠错方式推动问题解决的同时，明确规定了“依法作出纠正和撤销决定”的“刚性”纠错方式。
新增“联合审查”升级人大监督“工具包”
“备案审查是一项创制性工作，《决定》总结了实践经验，把备案审查中不少行之有效的做法，固定了下来。”严冬峰表示，根据备案审查启动的程序不同，审查方式可以划分为不同类型。实践中，备案审查部门主要运用依职权审查、依申请审查、移送审查和专项审查四种审查方式。
在四类审查方式基础上，《决定》新增“联合审查”方式，规定针对规范性文件存在涉及其他机关备案审查工作职责范围的共性问题的，可以开展联合调研或联合审查，共同研究提出审查意见和建议。这有助于提高审查纠错效率，避免审查机关推诿和审查空转。
“近几年，全国人大常委会法工委围绕野生动物保护、民法典实施、优化营商环境等多个方面，连续开展专项审查。”严冬峰介绍，专项审查是对相关领域的规范性文件的“大体检”，《决定》也将专项审查作为备案审查的一种方式固定下来。
严冬峰介绍，近几年，全国人大宪法和法律委员会、全国人大常委会法工委特别重视法律制定过程中对法律草案的合宪性审查，一些重要的法律，如对外关系法、爱国主义教育法等，在起草审议过程中都进行了合宪性审查，即按照宪法规定、原则、宪法精神，逐条审查法律草案是否符合宪法。
“中国的备案审查制度是人民代表大会制度的重要组成部分，这是与其他国家相关制度的本质区别。”严冬峰说，中国备案审查制度具有的独特效能，正在逐步显现。
一张邮票或“一键”公民即可“撬动”最高国家权力机关
在“法规体检”中，公民担任重要角色。2019年12月4日，第六个国家宪法日，全国人大常委会法工委在中国人大网上设立了审查建议在线提交端口。4年来，共收到超1.2万件公民、企业、各类组织在线提出的审查建议。
“凡是公民提出的审查建议，我们每一件都要登记并认真研究。”严冬峰说，审查过程中，全国人大常委会法工委法规备案审查室工作人员同时会通过电话、微信、当面等形式听取审查建议人的意见，补充材料，更好了解、解决问题。审查建议处理后，全国人大常委会法工委会向审查建议人反馈。
严冬峰介绍，下一步，全国人大常委会法工委将在推动备案审查信息化的同时，推动建设国家法律法规数据库，并在数据库上开设端口，供公民“一键”直达法规并提出审查建议。《决定》将进一步加强对公民的审查建议接收、登记、研究、审查相关的工作，完善相关的工作机制，以更高效方式回应人民群众需求，并强化与审查建议人之间的直接沟通。
目前全国人大常委会法工委在全国有30多个基层立法联系点。严冬峰表示，将充分发挥基层立法联系点的作用，和群众面对面，让备案审查能够更贴近群众。
